Terms of Use

Article 1 – Purpose

These Terms of Use (hereinafter “Terms”) define the terms and conditions of access to and use of the website kodyo.studio (hereinafter “the Site”), published by Kodyo SRL.

Access to the Site and its use imply full and complete acceptance of these Terms. If you do not accept these conditions, you are invited not to use the Site.

Article 2 – Definitions

  • Site: the website accessible at kodyo.studio
  • User: any natural person accessing the Site and browsing it
  • Content: all elements present on the Site (texts, images, graphics, logos, videos, software, databases, etc.)
  • Kodyo or Publisher: Kodyo SRL, publisher of the Site

Article 3 – Access to the Site

The Site is freely accessible to any User with internet access. All costs related to accessing the Site (computer equipment, software, internet connection) are the sole responsibility of the User.

Kodyo strives to keep the Site accessible 24 hours a day, 7 days a week. However, Kodyo reserves the right to suspend, limit or interrupt access to the Site at any time, particularly for maintenance, updates or any other reason, without notice or compensation.

Kodyo cannot be held responsible for any direct or indirect damages resulting from the unavailability of the Site.

Article 4 – Intellectual Property

4.1. Ownership of rights

All elements comprising the Site (structure, texts, graphics, images, photographs, videos, sounds, logos, trademarks, software, databases, etc.) are protected by the provisions of the Belgian Code of Economic Law and by international conventions relating to intellectual property.

These elements are the exclusive property of Kodyo SRL or are subject to an authorization of use for the benefit of Kodyo SRL.

4.2. Prohibitions

Any reproduction, representation, modification, publication, distribution, transmission, adaptation or exploitation, in whole or in part, of the elements of the Site, by any process whatsoever and on any medium whatsoever, is strictly prohibited without the prior written authorization of Kodyo SRL.

Any unauthorized use constitutes an infringement sanctioned by articles XI.293 and following of the Belgian Code of Economic Law, without prejudice to damages that may be claimed.

4.3. Exception

The User is authorized to consult the Site and reproduce extracts for strictly personal and non-commercial purposes, subject to mentioning the source.

Article 5 – User Obligations

The User agrees to use the Site in accordance with its purpose, these Terms and applicable laws and regulations.

The User specifically agrees not to:

  • Infringe public order or morality;
  • Transmit unlawful, defamatory, insulting, obscene content or content infringing the rights of third parties;
  • Attempt to harm the proper functioning of the Site, particularly by introducing viruses, Trojan horses or any other malicious program;
  • Collect or attempt to collect information about other users without their consent;
  • Use the Site for commercial purposes without prior authorization from Kodyo;
  • Circumvent or attempt to circumvent the technical protection measures of the Site.

Article 6 – Limitation of Liability

6.1. Information on the Site

Kodyo strives to maintain accurate and up-to-date information on the Site. However, Kodyo does not guarantee the accuracy, precision, completeness or timeliness of the information published.

The information on the Site is provided for informational purposes only and does not constitute professional, legal, technical or commercial advice.

6.2. Availability and operation

Kodyo does not guarantee:

  • Permanent and uninterrupted availability of the Site;
  • The absence of viruses or other harmful components;
  • The compatibility of the Site with all equipment and configurations.

6.3. Scope of liability

Kodyo’s liability can only be engaged in case of proven fault and will be limited to direct and foreseeable damages, excluding any indirect damage (loss of profits, loss of data, loss of customers, commercial damage, damage to image, etc.).

This limitation does not apply:

  • In case of fraud or gross negligence attributable to Kodyo;
  • To damages resulting from injury to life, physical integrity or health;
  • In cases where the law prohibits any limitation of liability.

Article 7 – Hyperlinks

7.1. Outgoing links

The Site may contain hyperlinks to third-party websites. These links are provided for informational purposes.

Kodyo has no control over these third-party sites and disclaims all responsibility for their content, availability, accuracy or privacy practices.

Activation of these links is the sole responsibility of the User.

7.2. Incoming links

The creation of hyperlinks pointing to the Site is subject to prior written authorization from Kodyo, except for simple links pointing to the Site’s homepage that do not harm Kodyo’s image.

Article 8 – Personal Data

Article 9 – Modification of Terms

Kodyo reserves the right to modify these Terms at any time, particularly to adapt them to legal, regulatory, jurisprudential or technical developments.

The applicable Terms are those in force at the time of the User’s use of the Site. The version in force is accessible at any time on the Site.

The User is invited to consult this page regularly. Use of the Site after modification of the Terms constitutes acceptance of the new conditions.

Article 10 – Severability

If any provision of these Terms is declared null or unenforceable by application of a law, regulation or final court decision, it shall be deemed unwritten. The other provisions shall retain their full force and effect.

Article 11 – Applicable Law and Jurisdiction

These Terms are governed by Belgian law.

In case of dispute relating to the interpretation, validity or execution of these Terms, and failing amicable resolution, the courts of the judicial district of Walloon Brabant shall have sole jurisdiction.
